1 | Acceptance of Terms

IcyBear Sense AI is operated by IcyBear Czech Republic s.r.o., Zámostní 1155/27, Slezská Ostrava, 710 00 Ostrava, IČO: 21129258 („IcyBear Sense“, „we“, „us“). Contact: support@icybear.io.

By starting a conversation with the IcyBear Sense chatbot on Telegram, you agree to be bound by these Terms of Service („Terms“). If you do not agree, do not use the Service.

2 | The Service

IcyBear Sense is an AI‑powered personal mentor and friend. It can chat, run web searches, analyse photos, exchange voice messages and join audio calls. IcyBear Sense is not a licensed therapist, medical professional or coach and the information it provides is for general purposes only.

3 | Eligibility

The Service is available worldwide to anyone with legal capacity to enter into these Terms and to comply with applicable laws. If you are under the age of digital consent in your jurisdiction, you must obtain permission from a parent or legal guardian.

4 | Access via Telegram

Using the Service requires a Telegram account. You are responsible for safeguarding your Telegram credentials and for all activity that occurs under your account.

5 | Fees & Payments

5.1 Free & Paid Features. Basic use may be free; premium features or usage packs may be subject to fees described in‑app.

5.2 Payment Processing. All payments are processed securely by third‑party processors FAPI, Stripe and Lemon Squeezy on our behalf. We do not store your full payment card details.

5.3 Billing. Prices are shown in the currency indicated before purchase and include taxes where required. Your purchase is complete once the payment processor confirms it.

5.4 Renewals & Cancellation. If a subscription renews automatically, you can cancel at any time in the billing portal linked in the chatbot or your receipt; access remains until the end of the paid period.

5.5 Refunds. We follow the refund policy displayed at checkout or required by law; contact support@icybear.io for assistance.

6 | Acceptable Use

You agree not to use IcyBear Sense to violate any law, harm others, transmit malware, infringe intellectual property or generate prohibited content (hate speech, harassment, sexual content involving minors, etc.). We may suspend the Service for misuse.

7 | Privacy and Data Security

7.1 Zero Human Access Policy

IcyBear Sense operates under a strict zero human access policy where no natural person from IcyBear Czech Republic, s.r.o., its employees, contractors, or subcontractors accesses:

• Content of messages exchanged between users and IcyBear Sense

• Personal information provided by users within conversations

• Derivative information obtained from such conversations

7.2 Technical Architecture

All user messages and information are encrypted on our servers using industry-standard encryption. Data is decrypted exclusively within secure, isolated systems for communication with AI models only. Our infrastructure operates on a zero-trust security model with multiple layers of protection designed to prevent any human access to user conversations. We maintain the highest standards of data security and privacy protection.

7.3 Privacy-First Commitment

Privacy and security are our fundamental priorities. We are committed to maintaining and continuously improving our systems to ensure user conversations remain private and secure. Our architecture and policies are designed to uphold the highest standards of data protection.

7.4 Legal Exception

This commitment is subject only to legally binding orders from courts or governmental authorities with proper jurisdiction.

8 | Intellectual Property

The Service and all original content, features and functionality are the exclusive property of IcyBear Czech Republic, s.r.o. and its licensors, protected by CZ, UK and international IP laws. You obtain no ownership rights by using the Service.

9 | Termination

We may suspend or terminate your access immediately for breaches of these Terms or if required by law. You may stop using the Service at any time by sending /stop in the Telegram chat.

10 | Disclaimers & Limitation of Liability

10.1 AI Disclaimer. Conversations with IcyBear Sense are generated by artificial intelligence and may be inaccurate or inappropriate. Use your own judgment before acting on any information.

10.2 No Warranties. The Service is provided „AS IS“ and „AS AVAILABLE“ without warranties of any kind.

11 | Changes to Terms

We may modify these Terms at any time. We will notify you of any changes by posting the new Terms of Service on this page and updating the „Last updated“ date.

12 | Governing Law & Disputes

These Terms are governed by English and Czech law.
